Dr. Morgentaler launched his final case against the province of New Brunswick, challenging the constitutionality of Regulation 84-20 under the Canadian Charter of Rights and Freedoms. Dr. Morgentaler also challenged Regulation 84-20 as violating the Canada Health Act. The New Brunswick government employed a variety of legal delays to prevent the Court reaching a decision. The Case was dropped after Dr. Morgentaler died in 2013.
