The Supreme Court of Canada struck down s. 251 of the Criminal Code, which had been in place since 1969. The majority of the Court held that s. 251 violated Section 7 of the Charter because the administrative scheme of the Therapeutic Abortion Committee (TAC) system was arbitrary and unfair, and thereby infringed on a women’s right to security of the person. This meant that the existing TAC system was deemed unconstitutional. To date, no further federal legislation specific to abortion has been passed.
