Following a prolonged legal battle between the government of Nova Scotia and Dr. Morgentaler, the Supreme Court of Canada found in favour of Dr. Morgentaler that Nova Scotia’s prohibition on performing abortions outside of an approved hospital was “aimed primarily at suppressing the perceived public harm or evil of abortion clinics.”
