In response to Dr. Henry Morgentaler performing abortions at his newly opened Clinic in Fredericton, the province used the powers granted to them by their amendments to Regulation 84-20 and Hatfield’s 1985 legislation which provided that a physician could lose their license for performing an abortion outside of an approved hospital. Dr. Morgentaler agreed to have the inquiry into his license suspension put on hold until a decision was reached on Morgentaler v New Brunswick (1994).
