The New Brunswick Court of Appeal rejected the province’s appeal. The majority of the appellate judges agreed with the findings of the trial judge and saw “no reason to recast his decision”. The decision also notes that the majority viewed the 1985 legislation to be “about something that the province views as socially undesirable conduct” rather than about professional standards and the provision of quality healthcare. The government sought leave to appeal to the Supreme Court of Canada. |
